All custody and access decisions are made using the best interests of the child test, as set out in section 24 of the Children’s Law Reform Act. The test sets out a number of factors that judges are required to consider in making decisions about custody and access.
Pamela will examine each criteria of the best interests of the child test in the context of a case involving violence against women and will make suggestions for frontline workers about evidence a woman can provide to support her application for custody of her children.
