Wording to limit abusive or excessive messaging
If your ex-partner sends abusive or excessive messages to you and the children
These are some examples of terms that can be included in a family court order where the ex-partner uses electronic messaging to abuse the woman and children:
The parties shall only communicate using [name of communication tool, e.g. Our Family Wizard, AppClose, email, etc.] to communicate about the children. The messages exchanged through this platform shall not be read by the children and shall only involve the exchange of information regarding the children’s care, scheduled activities and appointments, and any requests for changes in the parenting schedule. All messages between the parties regarding the children shall not be deleted nor shall they be forwarded to third parties without the other parent’s consent. Messages shall be brief, respectful, related solely to the children, with no reference to either of the parties or their activities. Absent an emergency, the parties shall not email each other more than ______ [set a realistic limit depending on parenting schedule, e.g. once per day, twice per week, once per week, etc.]
[Name of woman] shall maintain a separate email address for the children and [name of ex-partner] to communicate with each other. [name of woman] may monitor any messages between [name of ex-partner] and the children and determine if they should be delivered. The children may decide if they want to receive or send messages on this email address.
The [name of ex-partner] shall not communicate with [names of woman and children] by way of direct message, comments, “likes” on social media, text message or email from any device.
The [name of ex-partner] shall not send direct messages via social media platforms to [names of woman and children].
